MINUTES - REGULAR MEETING - BOARD OF SELECTMEN
LOCAL BOARD OF LIQUOR CONTROL COMMISSIONERS
DECEMBER 20th, 2000
NEWFANE TOWN OFFICE

Any and all corrections to the following minutes will be made at the 01/04/01 Board of Selectmen's Meeting and are considered unapproved until then. Corrections will be noted in the minutes of that meeting.

PRESENT:
Selectmen: Michael Rohan, Lynn Bedell, and Richard Dowley
Absent: Jesse Anderson and Carter Van Iderstine.
Also Present: Doris Knechtel, Administrative Assistant.

13. LOCAL BOARD OF LIQUOR CONTROL COMMISSIONERS
The Local Board of Liquor Control Commissioners meeting was called to order at 3:32 p.m. First Class Liquor License - Motion was made by M. Rohan and seconded by R. Dowley to approve the First Class Liquor License for Raymond J. Bachynski, DBA Chestnut Valley Inn. Unanimous. The business is located at the former the Coach House Inn and Restaurant. The LBLCC was adjourned at 3:35 p.m.

1. CALL TO ORDER
Chairman M. Rohan called the Regular Meeting of the Board to order at 3:35 p.m.

6. A. USDA/NRCS - AMENDMENT #1 - DEBRIS REMOVAL
An amendment to the original USDA, Natural Resources Conservation Service agreement with the Town of Newfane as the sponsor has been received to add the Harrington project to remove the debris from the Smith Brook. This project was not included with the Ballantine and Robinson projects. Motion was made by R. Dowley and seconded by L. Bedell to have Chairman Michael Rohan sign, on behalf of the town of Newfane, the required documentation for the amendment to Project Agreement No. 69-1644-1-4 between the USDA/NRCS and Newfane. Unanimous.

5. B. OTHER OLD BUSINESS
(1) M. Rohan spoke with John Spicer regarding the Village Enhancement Committee and the proposed plans for traffic calming for South Newfane and Williamsville villages. The committee may be asking for budgeted funds for engineering plans for implementing the current plans. The amount of funds has not been determined. Board members discussed possible things that may be done for traffic calming without engaging the services of an engineer. There may also be some engineering services available at the state level.

9. PAY ORDERS
A. Motion was made by L. Bedell and seconded by R. Dowley to approve the Newfane Payroll and Accounts Payable Warrants, as signed, for the following:

7. ADMINISTRATIVE ASSISTANT'S REPORT - (See attached report)
A. Item #1 - The Board suggested meeting with Angela Magara, State Hazard Mitigation Officer, early on the day of a regular Board meeting to discuss the application and the process of Property Acquisition through the Hazard Mitigation Grant Program in reference to the Don and Pat Williams property. The meetings in January will be on the 4th, 11th and 18th. A. Magara will be contacted about her schedule.

B. Item #5 - Before a decision is made to hire someone to shovel the walkways at the town office and to also possibly plow the parking lot before the opening of the office for business, R. Dowley will speak to J. Gray about having the town highway crew take care of the shoveling of the walks. J. Gray usually plows the parking lot but has been late in plowing the parking lot. 4. ROAD BUSINESS
A. ROAD COMMISSIONER'S REPORT - (No report was submitted)

B. ROAD FOREMAN'S REPORT - (See attached report)
No action was required by the Board of any of the items listed.

C. EXCESS WEIGHT PERMITS
No Excess Weight Permits were presented for action.

D. ACCESS/RIGHT OF WAY PERMITS
No Access/Right of Way Permits were presented for action by the Board.

6. NEW BUSINESS


B. FY 2002 BUDGET PROCESS
Expenditure Budget - The comparative expenditures and proposed budget figures received to date with the actual audited expenditures were reviewed by the Board on a line by line basis. Additional proposed numbers were added. Areas of discussion included: wage increases cost of living and merit basis, legal fees, digitizing of tax maps with Planning commission funds, Conservation Commission request for $320. , Constable/Sheriff's Department enforcement in designated areas, and proposed highway expenditures amounts. When all the numbers are obtained, then the Board will review the line items again for bottom line and tax implications.
Paula Sagerman has asked about the process for submitting an article for the warning to request funds for the Old School House in South Newfane owned by a private nonprofit organization.
Capital Budget - The Board reviewed the proposed capital expenditures for FY 2002. The highway equipment acquisitions of a new F-550 one-ton (current vehicle is a 1999) and loader (current equipment is a 1991) were questioned and will be further investigated as to mileage/hours, cost, etcetera. The amount proposed for engineering for River Road (TH#15) was deleted as most of the work has been accomplished. More funds will be put in for the Town Office improvements than was proposed.
At the next meeting of the Board to be held on January 4th, the expenditure, capital and revenue budgets will be reviewed again.

8. MINUTES
The minutes of the Regular Meeting of 12/07/00 will wait to be approved at the next meeting scheduled for 01/04/01.

10. CORRESPONDENCE
A. Change order has been received from Daniels Construction for the Brookline/Newfane bridge #19 for an additional $2,038 of which Newfane will be responsible for $50.95.

B. Information has been received from Larry Robinson, County Clerk, regarding the Windham County Budget for 2001 - 2002. The County Tax Rate will be $0.01049. Using the most recent "Equalized Educational Grand List", Newfane's assessment will be $11,788.55, unless changes are made to the County Budget at the annual meeting on January 17, 2001.

C. A copy of the information filed with the Vermont Supreme Court on behalf of the Town of Newfane on the Donald Miller and Linda Miller vs. Town of Newfane has been received from the office of Attorney Jane C. Krochmalny.

11. EXECUTIVE SESSION - An Executive Session was not required.

12. ADJOURNMENT
Motion was made by L. Bedell and seconded by R. Dowley to adjourn the Regular Meeting of the Newfane Board of Selectmen at 5:35 p.m. Unanimous.

Subject: Administrative Assistant's Report
Date: December 20, 2000

1. There is a letter and application form from Angela Magara, State Hazard Mitigation Officer. Would the Board like to meet with her to complete the application? I have asked Don Williams to furnish some of the information regarding an itemized list of damages to his property.

2. Jonathan Morse will not be at the Board's meeting until January 18th, 2001 at 7:00 p.m. He is coming to discuss drainage from Cross Street (TH#14) onto the Adele Graham property.

3. John Mudgett, CPA, was in on 12/15/00 to work on the audit. He gave me the adjusted numbers for budget purposes, which have been applied to your new comparative budget sheets.. There may be a few other adjustments, but nothing major. He expects to have a draft by the end of this week.

4. Two property owners called about there being drop-offs into their property on South Wardsboro Road (TH#1) because of the application of the paving. J. Gray has been notified. He will look at the situation about the side dressing and reason for the problem. (Debbie Keefe and Eve Hockwald)

5. I spoke with Rad Bloom of Brookline about shoveling the walkways at the town office. I also asked him about the possibility of plowing the town office parking lot. He will get back to me with a price for each job.



ROAD FOREMAN'S REPORT 12/20/00
TOWN OF NEWFANE HIGHWAY

1. Winter storms on 12/11/00, 12/14/00, 12/16 & 17/00, and on 12/20/00 have kept the road crew busy. The ice storm on 12/16 & 17/00 was one of the worst in 25 years. Many cubic yards of sand was required to keep roads open.

2. The flood work has stopped due to the winter freeze up.

3. The leaning pine tree fell on Dover Road (TH#2) this week taking down all utility wires. It was lucky no one was injured. The other dead or dying trees have not been taken down by CVPS.

4. Equipment: A. All equipment is operational. B. The Snow-King snowplow still needs repair.
