MINUTES - REGULAR MEETINGBOARD OF SELECTMEN |

Any and all corrections to the following minutes will be made at the 05/04/00 Board of Selectmen's Meeting and are considered unapproved until then. Corrections will be noted in the minutes of that meeting. APRIL 24th, 2000 NEWFANE TOWN OFFICE PRESENT:Selectmen: Michael Rohan, Jesse Anderson, Lynn Bedell, Richard Dowley and Carter Van Iderstine. Also Present: James O. Gray, Road Foreman, and Doris A. Knechtel, Administrative Assistant. 1. CALL TO ORDER Chairman M. Rohan called the Regular Meeting of the Board to order at 7:04 p.m. 2. SCHEDULED MEMBERS OF THE PUBLIC No members of the public were present. 3. UNSCHEDULED MEMBERS OF THE PUBLIC No members of the public were present 4. ROAD BUSINESS A. ROAD COMMISSIONER'S REPORT - (See attached report) The Board reviewed the report. No action was required on any of the items listed. B. ROAD FOREMAN'S REPORT - (See attached report) The Board reviewed the report. No action was required on any of the items listed. C. EXCESS WEIGHT PERMITS No Excess Weight Permits were presented that required action by the Board. D. ACCESS/RIGHT OF WAY PERMITS Access Permit #A00.01 - Nancy Baker. Motion was made by J. Anderson and seconded by R. Dowley to sign the Approval to Proceed and the Final Approval for Access Permit #A00.01 submitted by Nancy Baker on Wildwood Acres Road (TH#75) to install a limited use driveway to bring firewood to an outside furnace with the culvert requirement to be waived. Unanimous. The restriction and conditions are written on the permit. E. NEWFANE VILLAGE DRAINAGE - Discussed under 7. F. F. BRIDGE #14 - CONCEPTUAL PLANS REVIEW The conceptual plans for Bridge #14 by the South Newfane General Store have been reviewed. Items that need to be corrected are: change Marlboro Brook to Marlboro Branch and change Marlboro Branch Road (TH#3) to Auger Hole Road (TH#3). The septic line that crosses the bridge is not included on the plans and should be added. And the Board would like to confirm that the bridge rail is to be the black anodized aluminum rail with vertical spindles as requested. Motion was made by J. Anderson and seconded by R. Dowley to have Chairman Michael Rohan sign the Project Review Sign Off sheet for Bridge #14 with the above corrections and comments to be included on the document. Unanimous. G. OTHER ROAD BUSINESS (1) When asked about the placement of "Horse Crossing" signs on New Road (TH#30) J. Gray that the amount of traffic on that road would not warrant the placement of such signs. (See 7.A.) There shouldn't be any more signs than are necessary throughout town. (2) J. Gray agreed with the placement of a "_ To Parish Hill Road" sign on Baker Brook Road (TH#19) by Van Kirk Bridge (BR#41). He also agreed with putting up "Deer Crossing" signs on Depot Road (TH#2) where appropriate. (See 7.B.) He will order the necessary signs and posts. (3) A utility pole was knocked down by a "red jeep" within the village of Williamsville. The vehicles causing the damage has not yet been located. (4) J. Gray has painted over the graffiti that was put on the Williamsville covered bridge. The Sheriff's department was notified of the vandalism. 5. OLD BUSINESS A. APPOINTMENT - CONSERVATION COMMISSION - (2003) - No action taken. B. APPOINTMENT - PLANNING COMMISSION (1) - Term until 2003 - No action was taken. John Feifel has indicated that he is interested in being appointed to the position. It was noted that Joan Weir is the new chairman of the Planning Commission. D. MILLER V. TOWN OF NEWFANE UPDATE Chairman M. Rohan indicated that has not reached Attorney Jane Krochmalny, who will be representing the town of Newfane in the Supreme Court case of Miller v. Town of Newfane, to ask questions relating to a proposed settlement offer from the attorney for the Millers. The Board will discuss the matter further at the next meeting of the Board on May 4th. Attorney J. Krochmalny has entered an appearance for the town with the Supreme Court on this matter. E. OTHER OLD BUSINESS (1) There will be a dedication of the gardens in front of the Town Office on Sunday, May 21st beginning at 2:00 p.m. The Selectmen have previously proposed to putting in a plaque to honor the Newfane Garden Club for their appreciated efforts in improving the Town Office grounds. (09/02/99) Motion was made by L. Bedell and seconded by C. Van Iderstine to allow the expenditure of up to $150 for the purchase of a plaque to honor the Newfane Garden Club. Unanimous. The garden club will be putting a dedication plaque on a bench in the future. (2) The loam under the roll off recycling containers will be replaced with gravel as soon as weather permits. It will take about 75 yards of gravel for the project. WSWMD will assist with the project. (3) L. Bedell expressed her concern about the speed limit log sheets received from the WCSD and the fact time of the monitoring was not during rush hour, A.M. or P.M. M. Rohan will contact Deputy Farnum. (4) J. Anderson commented about the recent correspondence that has come through regarding the West River Acres Act 250 project. It is not clear from the information if the River Road (TH#15) project is included with this hearing process. J. Anderson would like to make sure that the town is represented during the proceedings. The town is automatically has party status in the Act 250 hearing process. (5) J. Anderson would like to discuss the Goals and Objectives for the Selectmen to achieve this upcoming year by reviewing previous lists. The proposed amendments to the zoning bylaw should be ready from the Planning Commission by the fall. River Road (TH#15), South Wardsboro Road (TH#1) Personnel Policy and Reappraisal were all mentioned for Goals and Objectives to consider. A list will be developed and discussed at the meeting of May 4th. (6) The bids for the mowing of the town cemeteries are due on May 4th. The question was raised putting this out for bid when the expense is usually less than $1,000 and the bid policy is for expenses of $2,000 or more. The advertisement cost between $55. - $60. The question was also raised about putting the Town Office mowing out to bid or to just have the person who performed the work last year continue. Motion was made by R. Dowley and seconded by J. Anderson to hire Marc Gray to maintain the lawn at the Town Office. Unanimous.
7. ADMINISTRATIVE ASSISTANT'S REPORT - (See attached report) A. Item #1 - There has been a request to install "Horse Crossing" signs on New Road (TH#30). The Board will wait until J. Gray arrives at the meeting to discuss the matter further. B. Item #2 - Again a request has been made to change the name of Beetlestone Hill Road (TH#47) as people are having difficulty in finding Parish Hill Road (TH#26). Suggestion was made to have a sign on Baker Brook Road (TH#19) by Bridge # 41, indicating "_ To Parish Hill Road". This will also be discussed further when J. Gray arrives. L. Bedell suggested that "Deer Crossing" signs be installed on Depot Road (TH#2). C. Item #5 - The majority of the required work in the Lister's office to create a new Grand List is being done by T. Schreyer without much assistance from the other elected Listers. R. Dowley and M. Rohan will speak with the other two Listers. D. Item #6 - The Board reviewed the permit fee schedule information, in particular the septic system fees, from the surrounding communities. After discussion, motion was made by M. Rohan and seconded by J. Anderson to increase the fee to $40.00 for new or replacement systems for dwellings and to increase the fee to $60.00 for new or replacement systems for commercial establishments. Unanimous. E. Item #8 - DAK will investigate the price of a used three bay sink to be installed in the Williamsville Hall kitchen. F. Item #10 - R. Dowley still feels that the town could save a lot of money by having the drainage from the area by the church go to the drop inlet at the far end of the grass triangle. At the meeting of 04/03, R. Stevens indicated that there would be more piping required with a clean-out in the middle. The elevations for drainage are marginal in the entire area. Digging up the pavement and replacing it would seem to be more expensive. Chairman M. Rohan will contact R. Stevens of Stevens & Associates about the status of the plans and question again the reason for not going to the drop inlet at the far end of the triangle area. G. An inquiry was received about renting the Williamsville Hall for one night for six consecutive weeks for classes of 2 to 3 hours for 10 to 15 people. After discussion, the Board agreed that the rate would be $25.00 per evening or $150 for the six-week session. 8. MINUTES The minutes of the Regular Meeting of 04/06/00 and the Public Hearing of 04/11/00 were reviewed by the Board. CORRECTION: Minutes of 04/06/00. M. Rohan would like the last sentence of Item #3 on page #2 rewritten to clarify the intent. Change to read: "If the Williamsville Hall is not insulated, the Board may consider a very limited use during the winter months." Motion was made by M. Rohan and seconded by J. Anderson to approve the minutes of the Regular meeting of 04/06/00, as corrected and the minutes of the Public Hearing 04/11/00, as written. Unanimous. 9. PAY ORDERS A. Motion was made by J. Anderson and seconded by M. Rohan to approve the Newfane Payroll and Accounts Payable Warrants, as signed, for the following amounts: 04/12/00 Payroll $ 2,611.37 04/15/00 Payroll $ 2,658.64 04/24/00 Payroll $ 221.64 04/21/00 Acct's Payable #21 $ 586.73 04/25/00 Acct's Payable #22 $ 260,257.97 Unanimous B. Copy of a letter to John Feifel from Michael marquise, P.E. regarding the 2000-gallon septic tank on the John Hedge property not being a problem for future installation of a mound system. B. New website for the town, thanks to Bahman Mahdavi. www.newfanevt.com C. Copies of correspondence between Attorney Timothy O'Connor and Linda Matteson regarding Land Use permit #2W1053 - West River Acres/Town of Newfane. The hearing will reconvene after the plans are received and reviewed by the District #2 Commission. D. Letter of thanks to the Town of Newfane for supporting Early Education Services. E. Copy of a Report from the Ad Hoc Act 60 Committee which has been accepted and endorsed by the Windham Regional Commission. F. Project Review Sheet for District #2 Commission regarding increase in number of rooms from 15 to 16 at the Four Columns Inn. No substantial change to pre-existing development. G. Report of the 1999 Water Quality Monitoring for the West River received from the Bonnyvale Environmental Education Center. H. Activity Reports have been received from the Windham County Sheriff's Department covering the time period from 02/20/00 through 03/18/00. 11. EXECUTIVE SESSION No matters requiring an Executive Session came before the Board at this time. 12. ADJOURNMENT Motion was made by R. Dowley and seconded by L. The road crew have done an excellent job with the roads this spring. I have had very few calls about bad muddy roads. 2. Jim has lifted most of the road closed signs. I had a call from Cloe Mantel about her mother coming home after an operation. They wanted the road smoothed out a little. Jim took care of it. Dick Dowley ROAD FOREMAN'S REPORT 04/24/00 TOWN OF NEWFANE HIGHWAY 1. The following roads were worked on since the last regular Board of Selectmen's meeting:
2. Culverts and runouts are being cleaned daily. Ditches are too wet to work in most places. 3. Equipment: A. The emergency brake was repaired at Rountree Ford on the F-550 truck (warranty work). B. The SnowKing plow is still at Vermont Municipal waiting on parts from Viking. C. The winter equipment that has not bee taken off for summer maintenance will be. D. All other equipment is operational. 4. The waste bin area will be dug out and filled with gravel very soon. Wet weather has been a problem. 5. Mud season posting will cease as of May 1, 2000; road closed signs to be taken down. 6. The entrance to the parking lot was graveled and smoothed up at the elementary school today. Unanimous. _ To: Newfane Board of Selectmen Memorandum From: Doris A. Knechtel Subject: Administrative Assistant's Report Date: April 24, 2000 1. Laura Perry of New Road (TH#30) called about having "Horse Crossing" signs put up on the road. When a request of this type came from Winchester Stables, the signs were purchased by the person making the request and the town installed them, I think. 2. JoEllen Falk called about the name of Beetlestone Hill Road TH#47) again. She feels that it should be changed to Parish Hill Road Extension or something as drivers are having difficulty finding Parish Hill Road (TH#26) from Baker Brook Road (TH#19). My suggestion would be to put a "_ To Parish Hill Road " sign on Baker Brook Road. 3. The dedication of the gardens at the Newfane Town Office to honor Dorothy Jones, will be on Sunday, May 21st at 2:00 p.m. Invitations will be forthcoming. 4. Thanks to Bahman Mahdavi, the town has a new website, www.newfanevt.com. 5. In reference to the Listers, Atty. Kathy DeWolfe of the Secretary of State's Office, that because they are elected officials, the only thing to do for those who do not come in is to talk with them. She did suggest that the town may want to contract with a professional appraiser to get the work done if necessary. Other area communities may want to share in such a contract. 6. Information on other area community permit fees is included in your folders. 7. In reference to the Miller v. Town of Newfane matter, I put together information on the assessed value of the Miller property comparing the past years with the so called settlement figure and how it relates to taxes. 8. I spoke with Tim Jeffers and he will have the information about the installation of a sink at the Williamsville Hall by the end of the week. (04/28). His price will include a new sink. He suggested that the town contact Kittredge in Springfield, MA for a used sink. 9. I called and left a message with Art Campbell to remind him about the Williamsville Hall electrical. 10. Stevens & Associates have not sent the plans for the village drainage. I have called and left two messages. 11. Nothing has yet been received from Tree Warden, Wm. Guenther, regarding the hearing of April 11th.
