SPECIAL EMERGENCY MEETING - BOARD OF SELECTMEN
MARCH 8th, 2004
NEWFANE TOWN OFFICE
PRESENT:
Selectmen: Piet van Loon, Gary Katz and Chris Williams.
Absent: Carleton Chaffee and Priscilla Cotton.
Also Present: Doris Knechtel as Administrative Assistant.
1. CALL TO ORDER
The emergency meeting was called to order by Chairman Piet van Loon at
1:35 p.m.
2. ISSUE REGARDING DOG INCIDENT - BROWN'S
Chairman P. van Loon spoke with C. Chaffee on the phone about the purpose
of the emergency meeting and left a message with P. Cotton about the emergency
meeting.
It seems that there was an incident on Browns Road (TH#45) involving a
resident walking along the road with her two dogs and a stroller and three
Aboxers@. The Board received a copy of the written statement from the
complainant and as well as the Sheriff's report about the incident.
Last summer the Board dealt with an incident involving the Brown's boxer
dogs that have attacked people and other dogs. As a result of meetings
in July and August it was ordered that the Brown's dogs, Josie and Jobee,
be muzzled to prevent biting whenever outside of the owner's house and
shall at a minimum be controlled by a leash when not on the owner's property.
If found unmuzzled and/or running at large, the dogs shall be seized and
euthanized by the Town Constable or the Animal Control Officer (WCSD).
Board members reviewed and discussed the reports of the incident in question
as well as the hearing decision of September 9, 2003. P. van Loon prepared
a draft letter to the Brown's to be delivered to them by the Sheriff's
Department. Changes were made to the draft letter and a final version
was presented. Motion was made by G. Katz and seconded by C. Williams
to have the Board members present sign the letter to Patricia Brown which
orders that the dogs be euthanized for violation of the Selectboard's
letter of August 8, 2003 and the decision of the September 9, 2003 hearing
conclusion and to ask that she voluntarily surrender Josie and Jobee to
the Windham County Sheriff's Department for the dogs to be euthanized.
Unanimous.
3. TO TRANSACT ANY OTHER BUSINESS THAT MAY LEGALLY COME BEFORE THE MEETING
A. P. van Loon meant to bring up the topic of meeting with the abutting
property owners, Stephan & Diane Brown, Fred Lawrence, Peter and Tara
Lilienthal, to Bridge #14 by the South Newfane Store to discuss the proposed
construction plans for the new bridge. He has suggested meeting at the
South Newfane Community Center. The state is also going to be talking
with the abutting property owners in the near future. The bridge is expected
to be replaced in 2007.
4. ADJOURNMENT
Motion was made by C. Williams and seconded by G. Katz to adjourn the
Special Emergency Meeting of the Board at 2:30 p.m. Unanimous.
