Board of Selectmen Meeting Minutes

Any and all corrections to the following minutes will be made at the 02/07/02 Board of Selectmen's Meeting and are considered unapproved until then. Corrections will be noted in the minutes of that meeting.

MINUTES - SPECIAL MEETING - BOARD OF SELECTMEN
JANUARY 24th, 2002
NEWFANE TOWN OFFICE

PRESENT:
Selectmen: Michael Rohan, Jesse Anderson, Fred Bacon, Lynn Bedell and Richard Marek.
Also Present: Doris Knechtel, Administrative Assistant.

1. CALL TO ORDER
The Special Meeting was called to order by Chairman M. Rohan at 6:00 p.m.

5. TO TRANSACT ANY OTHER BUSINESS THAT MAY LEGALLY COME BEFORE THE BOARD OF SELECTMEN
A. M. Rohan suggested to the Board that after reading in the newspaper some of the articles regarding the passage of a junkyard ordinance in Guilford, that maybe the Board should consider having a hearing in Newfane on the recently Board approved junkyard ordinance. Other Board members felt that a public forum on the matter would be beneficial and a positive approach to hear a broader input of citizens on the ordinance. M. Rohan is willing to write a letter to the editor or to have an article in the paper in let the public now of the hearing. It was decided to have the meeting on February 21st beginning at 7:00 p.m.

2. FINAL BUDGET APPROVAL
A. EXPENSES - The total proposed budget Fiscal Year 2003 for the operational expenditures for the Town and the Highway is $832,231. The Board will leave that number as it is and include that amount in Article 22 of the warning. The 5% increase for the Highway employees includes a 3% cost of living and a 2% special adjustment.

B. REVENUES - The proposed anticipated revenues to be received for FY 2003, other than the amount to be raised by taxation, is budgeted for $243,500. The amount of $243,500 includes the anticipated amount of $52,500 from the state highway bridge and culvert program. The Board will leave the revenue figure as proposed at $243,500.

C. CAPITAL - The capital plan, as revised, was reviewed for Fiscal Year 2003. The fund expenditures are expected to be $112,798 with $ 48,798 to be used from the capital reserve fund. (Article 20). Article 21 is included in the warning to borrow the other $60,000 needed for the anticipated capital expenditures. Article 19 will ask to raise $60,000 to be put into the capital reserve fund for future expenditures.

Motion was made by M. Rohan and seconded by F. Bacon to approve the above FY 2003 Budget amounts for the Expenses, Revenues and Capital expenditures. Unanimous. The estimated tax rate for the town in FY 2003 is expected to be $0.67 up from $0.60 for FY 2002. Last year (FY2002) there was a surplus of 73,520 and this year (FY2003) there is a deficit of $13,202.

3. FINAL ARTICLES OF WARNING
A petition has been received with the required number of signatures to have an additional article on the warning which reads: Shall the voters of the Town of Newfane vote to advise the Public Service Board, the Department of Public Safety, the Governor and our legislators of the following: WHEREAS we believe that the safety risks of nuclear power outweigh the economic benefits, we urge you to oppose the sale of Vermont Yankee, to reject any plan to relicense the plant or to permanently close Vermont Yankee at the earliest possible date. The article will be included in the warning.

The final articles, as presented, were reviewed and discussed by the Board. No changes were made to the warning as presented.

Motion was made by R. Marek and seconded by F. Bacon to sign the Articles of Warning for the March 5th Annual Meeting of the town of Newfane to be held at the Union Hall beginning at 9:00 a.m. Unanimous. Chairman M. Rohan thanked D. Knechtel for all of the work produced to bring the budgets and articles to a final decision. Other members concurred.

5. TO TRANSACT ANY OTHER BUSINESS THAT MAY COME BEFORE THE NEWFANE BOARD OF SELECTMEN - (cont.) B. Jim Gray spoke with DAK and he would like the Board to approve the posting of the roads for "mud" conditions as some of the roads, South Wardsboro Road (TH#1) in particular, are becoming muddy with the warm weather. Motion was made by M. Rohan and seconded by R. Marek to post the Notice to restrict the weight of vehicles using gravel roads to a maximum of 20,000 lbs. for tractor-trailer units. Unanimous.

C. R. Marek proposed a draft letter to be sent to P. O'Dell to inform her of the conditions that she needs to follow or the animals that are at the Windham Humane Society will be placed with new owners. Board members agreed with the draft letter and they also agreed that the action taken at the meeting of January 17th should also be continued. Motion was made by L. Bedell and seconded by F. Bacon to have Chairman Michael Rohan sign the letter on behalf of the Newfane Selectboard and that it be sent by registered mail to P. O'Dell with a copy to go to the Windham County Humane Society, the Constable and the Windham County Sheriff's Department. Unanimous. If her attorney can be identified, a copy will also be sent to him.

4. PAY ORDER
Motion was made by M. Rohan and seconded by R. Marek to sign the Accounts Payable Warrant #17 in the amount of $22,083.95. Unanimous.

6. ADJOURNMENT
Motion was made by F. Bacon and seconded by L. Bedell to adjourn the Special Meeting of the Board of Selectmen at 6:55 p.m. Unanimous.
