NEWFANE SELECTBOARD MINUTES January 4, 2010 NEWFANE TOWN OFFICE PRESENT: Selectboard: Dennis Wiswall, Jeff Gouger, Gary Katz, Todd Lawley Also Present: Sarah Henry, Gunther Garbe, Bruce Hesselbach, Richard Hickey, Virginia Grabowski 1. CALL TO ORDER Gary Katz, Chair, called the meeting to order at 6:30 p.m. Upper River Road: Todd Lawley gave his recommendations regarding the possible closure of Upper River Road, being signage limiting access to the road. Budget: The Selectboard reviewed the final draft of the Expenditure portion of the budget. A motion was made by Jeff Gouger and seconded by Dennis Wiswall to accept the town and highway expenditures, of $1,190,914.00. Road Foreman’s Report: See attached report. Permit for Laying Pipes and Wires: Jon Julian has applied for a permit for laying pipe under the road. After discussion, a motion was made by Todd Lawley to approve the permit, contingent upon ownership of the brown church, noting that the road must be returned to original pre-project condition, and that the applicant is responsible for traffic control; and that digging along side of the road should be out of the town right-of-way. The motion was seconded by Jeff Gouger. The motion carried unanimously. 2010 Certificate of Highway Mileage: A motion was made by Jeff Gouger and seconded by Dennis Wiswall to certify highway mileage for the coming year. The motion carried unanimously. 4. UNSCHEDULED MEMBERS OF THE PUBLIC Bruce Hesselbach, Conservation Commission Chair was present to speak to the board regarding its decision to level fund the Conservation Commission expenses. The project the Conservation Commission would like to see happen is tree removal in the town forest. The board felt as though it’s a danger now, not in 2011. A motion was made by Jeff Gouger to authorize the expenditure of $800.00 plus do the clearing at the overlook that can be done within the $800.00, and ask the Conservation Commission to contact Kevin Shrader. The motion was seconded by Todd Lawley. The motion carried unanimously. 5. NEW BUSINESS Resolution Authorizing Marshall Glickman to represent the Town in a Real Estate matter: Gary read the resolution as presented by Attorney Alexander Shriver. A motion was made by Dennis Wiswall to approve the resolution. The motion was seconded by Jeff Gouger. The motion carried unanimously. Town Meeting Location: Shannon explained that the Union Hall is closed until April, unless the town so chooses to pay to have it opened. The school is available and willing to host the Town Meeting, as is the NewBrook Fire Department. A motion was made by Jeff Gouger to utilize the Newfane Elementary School for Town Meeting. The motion was seconded by Dennis Wiswall. The motion carried unanimously. Todd brought up the 2009 Sterling bill charging for moving the fuel filter, which was a design flaw. He suggested that the town write a letter to L&B regarding the bill that we were sent. A motion was made by Dennis Wiswall and seconded by Jeff Gouger to authorize Todd Lawley to write a letter. The motion carried unanimously. Todd will work with Shannon on this letter. 6. OLD BUSINESS Shannon noted that there may be someone interested in being on the Planning Commission. 7. ADMINISTRATIVE ASSISTANT’S REPORT See Attached Report. The board decided to set a special meeting for January 14, to discuss the warning for Town Meeting 2010. The board asked Shannon to invite Chris Petrak, Moderator to the meeting for his input. A motion was made by Todd Lawley and seconded by Dennis Wiswall to add $1600.00 to the budget for the SEVCA appropriation, as their request was submitted before the deadline. The motion carried unanimously. 8. CORRESPONDENCE: Memo from Richard Dudman questioning the bylaw and suggested changes. The board passed the information to the Planning Commission for appropriate action. Information received from the State regarding the Town Forest. The board passed the information to the Conservation Commission for their review. Memo received from Gloria Cristelli, Town Clerk regarding additional electrical work to be done in the town office. The board asked Shannon to follow up with the electricians on this. 9. PAY ORDERS: Jeff Gouger made a motion to approve pay orders. The motion was seconded by Dennis Wiswall. The motion carried unanimously. 10. ADJOURNMENT A motion was made by Todd Lawley and seconded by Dennis Wiswall to adjourn at 8:25. The motion carried unanimously.
